Q: My best friend and her boyfriend, letâ€™s call him â€śPeter Pan,â€ť have been living together for ten years but he wonâ€™t propose because (1) commitment scares him and (2) heâ€™s a yutz who wonâ€™t grow up. But my friend says she doesnâ€™t mind because theyâ€™ve lived together for seven years so now theyâ€™re â€ścommon law marriedâ€ť anyway. Is that right?
A: Um, no. But itâ€™s a good question because it turns out â€ścommon law marriageâ€ť is not what most people think. To enter a common law marriage, you must first be eligible to be marriedâ€”that is, neither party is a minor or married to someone else. You must express words in the present tenseâ€”â€śwe are husband and wifeâ€ťâ€”not â€śweâ€™ll be together in the futureâ€ť or even â€śsomeday, baby, this will all be yours!â€ť Beyond that you need constant cohabitation and a â€śreputation for marriage,â€ť meaning you have held yourselves out to the community as husband and wife. Even with these things in place, only a handful of states recognize common law marriages. So though you may think itâ€™s hard to get him to say â€śI do,â€ť absent all that proof, itâ€™s probably even harder to get the state to say â€śyou did.â€ť
